Penalties for OUI in Massachusetts

OUI/DWI/DUI Penalties in Bristol County

With every OUI conviction, you face jail time, fines and the suspension of your license. The penalties vary, however, depending on the number of previous convictions you have:

  • First offense: As a first-time offender, you face up to two and a half years in jail, fines from $500 up to $5,000, and a one-year license suspension. For first offenses, however, there are alternate dispositions available.
  • Second offense: With a second conviction, you face a minimum of 60 days in jail and up to two and a half years incarceration. Additionally, you could face $600 to $10,000 in fines and a two-year license suspension. You will also have an ignition interlock device placed on your car; there are alternative dispositions also.
  • Third offense: With your third conviction, it is a felony offense. You face a minimum of 150 days and up to five years in prison, $1,000 to $15,000 in fines, and the loss of your license for eight years. An ignition interlock device will also be placed on your car.
  • Subsequent offenses: As with previous convictions, the fines, prison time and license suspensions increase drastically with each offense. Three or more convictions will result in a felony with increased minimum prison terms, and all repeat offenders are required to have an ignition interlock device placed on their vehicle.
